The Crown alleged that Gary White had shot Anthony Tapley six times with a revolver in the yard of his home in Maddington in August of 2001. It was alleged that Gary had shot Tapley as many as four times prior to him [Tapley] climbing over a 6-8 Feet high gate with a further shot fired into him as he reached the top of the gate, and the final shot fired into Tapley's head as he lay in the driveway on the outside of the gate.
The Crown alleged that Gary had shot Tapley over a $100 debt.
The Crown alleged that Gary had made death threats in relation to Tapley.
The Crown alleged that they had DNA evidence (blood) from Tapley on the gate where the crime was committed.
The Crown alleged that Gary had disposed of the body at a property at Northam by burning it on a bonfire. Bone fragments were discovered on the property.
